Suspension of LMIAs for low-wage jobs in Montréal and Laval: what you need to know

Since September 2024, the Canadian government has suspended the processing of Labour Market Impact Studies (LMIS) applications for low-wage positions in the Montreal economic region. This measure has been extended until November 30, 2025, and extended to Laval as of March 3, 2025.

What is an EIMT?

The LMIA is a document that a Canadian employer must obtain before hiring a temporary foreign worker. It demonstrates that no Canadian worker or permanent resident is available to fill the position in question.

Suspension details

• Regions concerned: Montreal and Laval.
• Period: From September 3, 2024 to November 30, 2025.
• Positions concerned: Those offering a salary below the provincial median threshold, i.e. $32.96/hour as of November 8, 2024.

Objectives of the measure

This suspension is designed to encourage local Canadian hiring in regions where the unemployment rate exceeds 6%, as is the case in Montreal (6.2%). It encourages employers to recruit available Canadian workers or permanent residents.

Exceptions

Certain essential sectors are not subject to this suspension, including :

• Primary agriculture
• Food manufacturing
• Construction
• Health care.

Consequences for employers and foreign workers

Employers in the affected regions can no longer submit new EIMT applications for low-wage positions until the end of the current suspension. Foreign workers wishing to fill such positions in Montreal or Laval will have to explore other options, such as targeting exempt sectors or regions not affected by the measure.
